Daniel A. Scola, Jr., Managing Partner, Hoffmann & Baron, LLP, was a recent guest on ‘New Jersey Business Podcast’.

In a wide-ranging conversation with Host Paul Valverde, Scola discussed the various ways to protect your intellectual property (IP) assets. He explained the importance of protecting these assets from the inception of your company or creative work.

Scola highlighted some of the factors that differentiate Hoffmann & Baron, LLP from other IP law firms. He stated, “For a firm our size, we have many differentiating factors. One of them is the procurement side and the enforcement side. The procurement side is obtaining the intellectual property for the client, getting them the patent, getting them the trademark, getting them the copyright. The enforcement side is then enforcing those rights in the court systems and litigating it.”

Many IP firms only have the capability to handle the procurement side, but not the enforcement side and vice versa.

Scola mentioned many of the attorneys at Hoffmann & Baron have had careers before they became lawyers.  They were scientists, chemists, engineers, etc. and have personal familiarities with  these fields. Scola elaborated, “In the scientific arena, our attorneys had once been at the bench doing the work… meaning they have hands-on experience, so they know what the inventors, engineers, chemists, etc., are going through. They understand their client’s language and that enables them to ask better questions.”

Another unique aspect that sets the firm apart from their counterparts is the firm is global and has an expansive amount of European work. Scola stated, “We have been very involved in the European patent opposition practice….” Scola explained that this is unusual for a US frim to have been as involved in this particular aspect of European practice and that clients have benefited from this experience.

Lastly, Scola explained the firm’s entrepreneurial spirit.  Each Hoffmann & Baron, LLP office, New York, New Jersey, and Washington, DC, operate as their own entrepreneurial or micro-business.  Scola spelled out that he wants the attorneys “to think like they are running small businesses.” This business strategy is a main component of Hoffmann & Baron’s success as it aids in building a deeper relationship between the firm and their clients.
